Who Can Serve Original Process?

• In most cases across Pennsylvania, original process (e.g., a Summons and Complaint starting a civil lawsuit) can be served by a Private Process Server like Krayer Detective Agency, a competent adult or the Sheriff within the state.
• A competent adult (like a Private Process Server) can also serve in specific situations:
  • Actions seeking injunctive relief, perpetuation of testimony, or appointment of a receiver.
  • Partition actions.
  • Declaratory judgment cases where declaratory relief is the only remedy sought.
  • Civil actions with complete diversity of citizenship (all plaintiffs from different states than all defendants), and at least one defendant is a Pennsylvania citizen.
• For Domestic Relations matters (Divorce, Custody, Support), service follows separate rules allowing competent adult service or Private Process Server. Protection from Abuse orders must be served the Sheriff.
