Who Can Serve Original Process?

A competent adult (like a Private Process Server) can also serve in specific situations:

Actions seeking injunctive relief, perpetuation of testimony, or appointment of a receiver.

Partition actions.

Declaratory judgment cases where declaratory relief is the only remedy sought.

Civil actions with complete diversity of citizenship (all plaintiffs from different states than all defendants), and at least one defendant is a Pennsylvania citizen.

For Domestic Relations matters (Divorce, Custody, Support), service follows separate rules allowing competent adult service or Private Process Server. Protection from Abuse orders must be served the Sheriff.

If the Sheriff is a party to the case, service is by the coroner or authorized officer.

Time Limits for Service
